Licenses

2. Licensing Terms and Conditions

Beasts of England acts solely as the authorized licensor and distributor of the fonts licensed under this Agreement. All copyrights and intellectual property rights in the font designs and software remain the property of the original designer(s), who retain full ownership. This EULA grants you a license to use the Font Software, but does not imply or constitute a transfer of ownership of any intellectual property rights.

Nothing in this EULA shall be interpreted as transferring any ownership of the Font Software or its underlying designs to the Licensee. The Licensor distributes and sublicenses the Font Software on behalf of the Designer, who remains the sole and exclusive rights holder. Licensee agrees that the original Designer is the exclusive owner of any and all intellectual property rights in and relating to the Fonts, including copyrights for the Licensed Software, trademarks for the names of the Fonts, and protection for the glyphs generated by the Licensed Software under patent, copyright, or trade dress law, if applicable, to the fullest extent of the law in the jurisdiction where the Licensed Software is downloaded or used.

Beasts of England distributes Font Software both as original author and under agreements with contributing designers. In all such cases, Beasts of England has full authority to issue licenses and define licensing terms. Licenses purchased directly from Beasts of England are governed exclusively by the Beasts of England End User License Agreement (EULA). Licenses for fonts are modular by design. Basic rights, such as Desktop or Web use, may sometimes be available through different distributors. However, extended usage rights that apply to brand-wide communication, including Logotype, Social Media, Paid Advertising, and Broadcasting; are issued through Beasts of England. By completing a purchase from Beasts of England, the licensee expressly acknowledges Beasts of England's authority to license the Font Software, accepts the scope of use as defined herein, and agrees to the EULA. The licensee is solely responsible for securing the appropriate additional licenses for any extended uses.

Unless otherwise permitted by law, Licensee shall not, at any time during or after the effective Term of the Agreement, dispute or contest, directly or indirectly, the Designer's exclusive right and title to the Software Product or the validity thereof. All intellectual property rights remain with the Designer(s). You agree not to copy the Font Software or create derivative works based upon the Font Software and/or the design of the Font embodied in the Font Software. You hereby agree that this term is contractual in nature and that the unauthorized use of the design of the Font and/or the Font Software shall be an infringement of the Designer's rights, causing significant monetary harm. You further agree that such damages cannot be readily estimated and that the Designer and/or Beasts of England shall be entitled, without the obligation of a bond, to seek a restraining order to prevent any unauthorized uses. All rights granted under this Agreement are strictly limited to the scope of the license purchased. Any use not expressly permitted is prohibited.

2.1 The Desktop License

The Desktop License permits installation and use of the Font Software on desktop computers for the creation of printed and static visual materials. It governs the internal production of assets only. Any rights related to public distribution, digital embedding, online use, paid advertising, broadcast, resale, template distribution, server deployment, or other forms of extended commercial exploitation are not included and require the appropriate additional license (e.g., Web, Social Media, Paid Advertising, Server, Logotype, or Extended Print).

Beasts of England’s Desktop Licenses are based on company size, (total number of employees) not on the number of individual users installing the Fonts. There are two licensing options depending on who benefits from the use of the Fonts:

a) The Design License - Pre-production use.

For freelance designers, studios, and agencies creating work for clients. User limits don’t apply, and the Fonts may be used for design, prototyping, and presentations across unlimited client projects, in perpetuity.

Design Licenses cover only pre-production work and do not permit publishing, distribution, or internal brand use. Each client must obtain a Company License before any publication, release, or commercial use of the Fonts.

Studios using the Fonts for their own branding require a Company License based on team size.

Personal and self-promotional use (mockups, portfolios, or social media posts) is allowed with attribution (e.g. “Typeface: Lovechild by Beasts of England”), as long as the Fonts are not used as a permanent brand identity or in commercial products.

If you purchase on behalf of a client, select the correct company size and list their name and project at checkout. Your work will then be covered by the client’s Company License, but the Fonts may not be reused for other clients.

If the Fonts are not shared with the client, the work may be created using a Design License only, but the final usage must also be licensed, either by you or the client, through the appropriate Add-on License (e.g. Logotype, Social Media, Advertising).

b) Company License - Publishing the design / Commercial Use.

The Company License must reflect the total number of employees of the licensed company, not the number of people installing the Fonts. Required for any company, brand, or organization using the Fonts in connection with its business, whether for public or internal purposes. This includes internal documents, presentations, reports, and materials used within the company, even if the materials are not publicly distributed, or other materials that directly or indirectly benefit the company. This license allows commercial use of the Fonts in printed, still-image materials and digital documents, excluding motion graphics or dynamic digital use, and is limited to 10,000 printed units per year. Extended or perpetual print rights may be negotiated separately.

Clarification: “Company size” refers to the total number of employees and long-term collaborators (permanent, temporary, and part-time) working for the licensed company and all its directly or indirectly owned subsidiaries, affiliates, or connected entities operating under the same brand or corporate group. If the Fonts are used across multiple companies, brands, or divisions under common ownership or control, the combined number of employees of those entities determines the applicable license tier. Each separate legal entity or brand using the Fonts publicly must either be included in the licensed company’s declared size or hold its own valid license.

A Company License covers the company’s internal teams and any external collaborators working exclusively on its behalf (such as agencies, printers, or developers). These collaborators may install and use the Fonts solely for that client’s project and must delete all copies once the collaboration concludes.

Hero Text Clarification: Use of the Fonts in any logotype, trademark, product name, slogan, tagline, or any recurring or distinctive typographic element used to identify a brand, product, or campaign constitutes use in a brand identity and requires the purchase of a Logotype License in addition to the Desktop License. This includes any principal or prominent text element used for identification or branding purposes, regardless of size, placement, or frequency of use. This applies to all media, including packaging, advertising, and promotional materials. Customization, modification, or partial use of the Font Software does not exempt such use from requiring a Logotype License.

Printed Units Limit: All Desktop Licenses are limited to 10,000 printed units per year. For larger production volumes, an Extended Print License is required. Perpetual or multi-year extensions may be negotiated upon request.

The Desktop License covers printed materials distributed directly by the licensed company through its own channels. It does not cover use of the Fonts in connection with paid media placements or advertising campaigns involving purchased media space. A separate Paid Advertising License is required for use in out-of-home advertising (including billboards and digital outdoor networks), print advertisements placed in third-party publications, sponsored social media, digital display advertising, or broadcast media. Paid Advertising Licenses are based on total media spend and may be time- and territory-limited.

Files: Desktop Fonts are delivered as PostScript OpenType font files in OTF format.

Use on Online Creation Platforms (e.g., Canva, Figma, Notion): The Fonts may be uploaded to online creation tools only for the licensee’s internal use. Access must be restricted to users covered by the company’s license tier. If the Fonts are shared within these platforms with additional collaborators (freelancers, agencies, or partners), those users are considered part of the company’s active team for licensing purposes. Inviting or allowing repeated access to numerous external users may require upgrading to a higher Company License tier that reflects the company’s true operational scale. The Fonts cannot be made available to the platform itself or to third-party users outside the organization. Assets created with the Fonts may not be offered for resale or distribution as templates, mock-ups, or similar products.

Restrictions:

YOU MAY NOT use the Desktop Fonts to create a logotype without purchasing a Logotype License.

YOU MAY NOT upload .otf files to the web; a Web License (.woff files) is required.

YOU MAY NOT create physical or digital objects intended for commercialization (e.g., wooden letters, stickers, stamps, NFTs, etc.) without prior authorization.

YOU MAY NOT use the Desktop License to create web banners or static images for online display without acquiring the appropriate license (e.g., Social Media, Web, Paid Ads).

Clarifications: Use of the Fonts as static images in email signatures or newsletters is included in the Desktop License. Embedding the Fonts to allow live text editing within emails or digital tools requires a Server License.

2.2 Logotype License

Important: No font files are provided with this license. You must either purchase or already own a valid Desktop License for the fonts you intend to use. The Logotype License is an extension of the Desktop License and grants additional rights to use the Font Software in logotypes and branding systems.

Permitted Uses and Restrictions: This license grants you the right to use the Font Software to create logotypes, slogans, campaign lock-ups, packaging titles, or other typographic compositions that function as trademarks or key brand identifiers. Customization or partial use of the font still requires a valid license.

Limitations: Licenses are limited to one project and to the number of employees selected from the Beasts of England licensing table, referring to the trademark owner and all related entities involved in the project. After the logotype is created, it may be used in any context or medium without further fees. The fee is one-time only; the company may grow with no additional cost, provided the correct license tier was selected at the time of purchase.

Employee Count and Corporate Structure Requirements: For the purpose of licensing, Company Size is defined by the real operational scale of the brand. This includes the direct employees of the licensee company as well as the workforce of parent companies, subsidiaries, sister companies, contractors, or other related entities that directly or indirectly benefit from, fund, control, or distribute the brand, service, product, or project associated with the logotype. Outsourcing or creating intermediary entities does not reduce the effective size of the company. The use of shell companies, subsidiaries, or special-purpose vehicles (SPVs) to obtain a license tier below the actual scale of the project is strictly prohibited. Licenses must always reflect the scale of the parent company or controlling organization, even when the logotype is created for a smaller branch, subsidiary, or project. The number of employees may not be reduced on the basis that only a smaller team is directly involved. If a brand, product, or project is owned, funded, or distributed by a larger company, the employee count of the larger organization must be used to determine the license tier.

The only exception is if the smaller entity is a legally independent company that is entirely separate from the larger organization. To qualify as independent, the entity must not share ownership, funding, management, infrastructure, resources, distribution, or services (such as HR, finance, legal, or marketing) with the parent or affiliated company. In such cases only, licensing may be based solely on the employees of that independent company.

If the company is newly formed, the license size must reflect the realistic scale of operations expected within the first year, meaning the estimated number of employees by the end of the first year of activity.

If your company has a more complex structure, please reach out with the details so we can help determine the correct license size. We reserve the right to request documentation to verify compliance with this clause. If there is any uncertainty about which entity should be licensed, especially in complex or multi-party corporate structures, it is the client’s responsibility to contact Beasts of England before making a purchase. Failure to do so may result in the license being deemed invalid.

Transfer and Ownership Changes: Licenses are non-transferable. In the event of a merger, acquisition, or change of control, the license must be updated in accordance with Section 7 of this Agreement.

Embedding

5. Embedding and restrictions

You are only permitted to embed the Font Software in Adobe® Acrobat® (PDF) documents, solely for the purposes of presenting information and designs to others or for sending designs to a service bureau or printer for output or other preparation for production. You hereby agree that any PDF shall be made in a secure manner that allows only viewing and printing of the PDF, and not the editing or alteration of the content. Font Software shall be SUBSET when embedded and the PDF document shall be set as NON-EDITABLE. If you are not sure how to subset and/or create non-editable PDFs, consult the manual or publisher of the software application from which you are exporting PDFs. You are not permitted to embed the entire character set or substantially all of the character set comprising any Font that is subject to this License. Use of Font Software in PDF documents for sale or products utilising other forms of embedding of the Font Software for sale (for example as part of a commercial product such as a design template or an electronic book or use with a mobile device) is prohibited, and requires the purchase of a special license which may or may not be granted at the discretion of Beasts of England.

All Font Software created pursuant to this subparagraph must comply with all of the following:

The Embedded Font Software File must not allow any exportable content rendered in the Typefaces; The Embedded Font Software File must not, through any act or omission of Licensee, allow any Person, or any other software operating on the same Computer to access or use the Licensed Software; Licensee must use the same techniques to protect the Licensed Software as Licensee uses to protect the other contents of the Embedded Software File; Licensee must enable all applicable Security Features provided by the file format of the Embedded Software File, and must use best efforts to adopt new, superior Security Features as they become generally available; failure by Licensee to fully enable the Security Features of an Embedded Software File is a material breach of this Agreement and will result in its immediate termination without notice; Licensee must store the Licensed Software within the Embedded Software File such that all path names and file types are non-obvious and do not reference (a) any trademarks of Licensor, (b) any typographic term of art, or (c) any file name extension associated with fonts and typography, such as .ttf or .otf.

Internet use: You are permitted to use the Fonts to make GIF, JPEG, and PNG pixel-based images for use on the Internet as part of a website design provided that the image creation is not automated, the images are made personally by a Licensee and not generated by a server, and that no embedding or other transmission of the Font Software is made possible.

Web-fonts: If you have purchased a license to use the Fonts for Web Use ("Web EULA") covers any Web-fonts created by Beasts of England ("Foundry") and purchased through the beastsofengland.co website, (individually and collectively, the "Licensed Web-font(s)"). By using the Licensed Web-font(s) on any HTML website or webpage ("Website"), the purchaser (the "Licensee") agrees to the terms and conditions of this Web EULA. The Licensee may use the Licensed Web-font(s) only on the web, for styling Websites using the @font-face selector in CSS files at the Domains and subdomains licensed under this Agreement.

Embedding the Font Software in Web pages is expressly prohibited. You are not permitted to use the Font Software in connection with embedded font objects or by any other means that embed the Font Software for the purposes of displaying the Fonts on the Internet or on wireless Web browsers. You are not permitted to use the Fonts with Adobe® Flash® software. If you wish to use the Font Software for such purposes, you must purchase a special license.

You are not granted any right to use the Licensed Software in any application controlling aircraft or other modes of human mass transportation, nuclear or chemical facilities, life support systems, implantable medical equipment, motor vehicles, weaponry systems, or any similar scenario (collectively, “High Risk Use”). Licensor and its suppliers disclaim any express or implied warranty of fitness for High Risk Use.

The fonts must not be used in any obscene, immoral, infringing, defamatory nature, be involved in any material that may bring any person or property reflected or described in the content into disrepute or cause any legal action.

Restricted installation of the fonts on a server for serving fonts to users. If you wish to use the font software in a manner that is restricted under this license, contact Beasts of England for information about special licensing.

It is prohibited to Install or use the Licensed Software on any Computer, except as specified on your Order Document(s), any Web Server, or in any manner that allows any Person or Computer to access the Licensed Software other than as expressly provided for in this Agreement, including, without limitation, causing the Licensed Software to be displayed on a web page using the CSS @font-face rule; or permit or enable any other Person or Computer to use the Licensed Software in any way; or Continue to use any Licensed Software, or Beasts of England Property after termination of your Agreement.

It is prohibited the Storing, caching, serving or otherwise providing access to the font software to third parties via the internet for use or display on the internet, irrespective of the format or technology used. Transfer of License

7. Transfer of License

7.1. Mergers, Acquisitions & Ownership Changes

If your organisation undergoes a merger, acquisition, or is absorbed by another legal entity, you must inform Beasts of England at least 10 business days prior to the transaction. If the new entity intends to use the Font Software more extensively than before, Beasts of England will require an upgrade of the current licenses and payment of any applicable fees. Unauthorized transfers are null and void.

The Licensee may not sell, lease, sub-license, assign, or otherwise transfer (each, a “Transfer”) any rights, obligations, or access to the Font Software, in whole or in part, to any third party or affiliated entity, including by merger, internal restructuring, or operation of law.

If the Licensee is part of a corporate group, such as a parent company, subsidiary, joint venture, or associated brand, the license does not extend to any other affiliated entity, publication, business unit, or client, even if under common ownership or control. Each such entity must obtain its own separate license.

Any unauthorized Transfer will be considered null and void and may result in immediate termination of the license.

7.2. Named Licensee and Attribution

All licenses must be issued in the name of the end client (the company or individual for whom the fonts are ultimately being used), regardless of who completes the purchase. The client’s name and project must be clearly provided at the time of purchase to properly attribute the license.

Only the licensed client may use the Font Software, unless otherwise specified under an appropriate Desktop user license. Unauthorized use or reassignment of the fonts to other parties is strictly prohibited.

7.3. Agencies, Designers, and Shared Usage

Agencies, studios, or designers may purchase on behalf of a client, provided the Company License is issued in the end client’s name and the correct company-size tier is selected. The client’s legal name and project details must be provided at checkout (Step 2).

Agencies and studios may use a Design License (Pre-Production) for internal creative work and client proposals, user counts do not apply. Publishing or production for the client requires the client to hold a Company License matching its company size.

A Company License covers the licensed company’s internal teams and authorized external collaborators working exclusively on its behalf (e.g., agencies, printers, developers). Collaborators must delete the Fonts after the project concludes.

Desktop licensing under this Agreement is not determined by user or device counts and does not require “multi-device” coverage; scope is based on company size (see §2.1).

7.4. Markup and Resale Restrictions

You may not resell, sublicense, or mark up the cost of any license. Licenses must be billed to your client at the exact price paid to Beasts of England. The fonts may not be bundled into other services or products for commercial gain.

7.5. Client Access and Responsibility

If your client requires access to the working font files, for example, for internal use, ongoing development, or campaign expansion, they must purchase their own licenses.

Clients are responsible for understanding the limits of their license, including number of employees, media types, formats, and duration, and for ensuring they remain within those boundaries. Exceeding the licensed scope without proper upgrades constitutes a violation of this agreement.

You may make one copy of the font files for backup purposes. If there is any doubt as to a permitted use, please contact simonwalkertype@gmail.com.

Audit

8. Audit

We may, at any time, request an audit in order to confirm that you are complying with the terms of this EULA. Within 10 days after receiving a notice of audit from Beasts of England, you will provide a certified statement of the computers, servers, websites, applications or other sources where the Font Software or Vector Graphics may reside, be saved or be accessed, (with all identification information, including serial or other identifying numbers), and you will permit Beasts of England or its designated agent to inspect (in person or via remote access) during normal business hours the Font Software and your facilities, machines, and records to verify your compliance with this EULA. In the event the audit reveals any noncompliance, you will make a payment to BEASTS OF ENGLAND within fifteen (15) days in connection with any applicable units of the Font Software, provided, however, that this will not limit BEASTS OF ENGLAND's rights and remedies. The obligations and terms set forth in this section will survive termination of this Agreement for a period of one (1) year. Failure to comply with an audit request constitutes a material breach and may result in termination. The Licensee is solely responsible for the accuracy of all information provided for licensing purposes. Any underreporting constitutes a material breach.

Payments

9. Payments and Fees

A valid credit card number is required in order to enter into this Agreement: You hereby represent and warrant that you are authorised to use the credit card provided to us in association with this Agreement. If Licensor cannot process your credit card for any reason, delivery of Licensed Software may be delayed until payment can be processed.

In consideration for the rights granted to Licensee hereunder, Licensee shall pay to Licensor a license fee specified on the Order Document(s), payable on the date the Licensee enters into this Agreement. Fees for Licensed Software are posted on our website, and may be changed from time to time. Changes will not be applied retroactively to existing licensees.

By purchasing and downloading digital font files from this website, you acknowledge and agree that you will lose your statutory 14-day right of withdrawal once the download or access to the licensed digital content has started.

Refunds: All amounts paid pursuant to this Agreement are non-returnable and nonrefundable. Lack of use, partial use, or discontinuation of use of the Font Software does not entitle the Licensee to any refund, credit, or cancellation of the license. No exceptions will be made. All fees will not include, and Licensee is responsible for paying any applicable sales, use, gross receipts, excise, import, export, value added or similar taxes. Each party will bear its own taxes as levied under applicable law. If the Font software does not function correctly, please contact Us within 15 days of purchase to arrange replacement of software. Due to the nature of digital Font software, Beasts of England does not offer refunds or store credit for change of mind or incorrect purchases. Transfer of Rights Prohibited. In the event that a refund is granted under exceptional circumstances, processing fees charged by our payment provider (Stripe) are non-refundable and will be deducted from the refund amount, and any license previously granted shall be considered immediately revoked. Continued use, installation, or representation of the license after a refund is strictly prohibited and may constitute a breach of contract. Unauthorized chargebacks after delivery or use of the Font Software constitute a material breach of this Agreement.

Liability

10. Disclaimer of Liability

To the extent permitted by applicable law, Licensor disclaims all liability for any loss, cost or damage, including without limitation indirect, special, consequential, or incidental damages, including any lost profits or lost savings, loss of goodwill, business interruption, work stoppage, loss of data, or computer failure, damage or malfunction, or for any claim by any party, even if licensor has been apprised of the possibility of such damages, and regardless of the theory (including contract, tort, strict liability, negligence or otherwise) upon which such claim is based. In no event shall Licensor’s total liability to Licensee for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount paid by Licensee under this agreement. The foregoing limitations will apply even if the above-stated remedy fails of its essential purpose. Licensor and Licensee acknowledge and agree that these limitations are an essential element of this agreement and that the price for the Licensed Software is determined in part by taking into account the existence of these limitations.

No Warranty. The font software and related documentation are provided "as is" and, except as noted herein, is without warranty of any kind and Beasts of England and its affiliated companies (together, "Beasts of England") hereby expressly disclaim all warranties, express and implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.

Beasts of England does not warrant that the operation of the font software will be uninterrupted or error-free, or that the font software is without defects. The font software is not fault-tolerant and is not intended and was not designed or manufactured for use in any circumstances where fail-safe operation may be required.

Under no circumstances shall Beasts of England be liable to you or any other party, whether in contract or tort (including negligence) or otherwise, for any special, consequential, or incidental damages, including lost profits, savings or business interruption as a result of the use of the font software even if notified in advance of such possibility. BEASTS OF ENGLAND's liability to you shall in no event exceed the refunding of the cost of the licensing fee or replacement of the font software, either at Beasts of England's sole discretion.

Licensee understands and agrees that Licensee downloads and/or uses the licensed software at Licensee’s discretion and risk and that Licensee will be solely responsible for any damages to any computer or loss of data that results from the download or use of the Licensed Software.

In the event of a breach of this license agreement or any infringement of the Designer's intellectual property rights, Beasts of England may act on behalf of the Designer to enforce the terms of this agreement. However, the Designer, as the original copyright holder, retains the exclusive right to pursue legal action for copyright infringement, including but not limited to seeking remedies for unauthorized use or distribution of the Font Software. Beasts of England will cooperate with the Designer to ensure enforcement of the terms of this EULA, including supporting the Designer in taking appropriate legal action in the event of a breach. The Designer may also take independent legal action if deemed necessary to protect their copyright and intellectual property rights.

This non-disclosure clause shall survive the termination or expiration of this Agreement. The Seller (Foundry) likewise agrees to maintain strict confidentiality regarding any information disclosed by the End-User about potential projects or applications involving the licensed font software. 15. Termination

This License Agreement is effective as of the date of full payment for the License. This License Agreement may be terminated by you at any time by destroying the Font Software, together with any printed material and all copies of the Font Software. This License Agreement may be terminated without notice if you breach or fail to comply with any term contained herein. Any use of the Font Software outside the scope of the granted license, constitutes a material breach and results in termination of all licenses granted under this Agreement.

Any breach of the terms of this License shall be cause for immediate termination without the obligation of notice or opportunity to cure. Beasts of England shall be entitled to seek any and all remedies under law or equity, including, without limitation, injunctive relief without the obligation of posting security or bond.
